FAX 01903 744884DEFINITIONS. The title GR Sound Solutions hereinafter referred to as the Owners. The Hirer hereinafter referred to as the person, Firm, limited Company, Corporation, Public Authority, or any Body hiring the equipment from the Owners. The term equipment means are sound, lighting or recording equipment and all ancillary accessories. 1. EQUIPMENT OWNERSHIP. All equipment hired to the Hirer remains the property of the Owners. It is incumbent on the hirer to keep the equipment in his possession and in his control and to inform the owner of the address where the equipment is to be used. The equipment may not be transferred to an alternative site without the permission of the Owners. The Hirer shall keep the equipment free from all legal processes. No mortgage, deed, bill of sale or any other legal instrument, contract or private arrangement whatever shall be executed whereby any person or any Body other than the owner shall acquire any lien or rights whatsoever in the equipment. The Owners reserve the right to determine the hiring by giving notice to hirer that unless the equipment be returned forthwith the owners shall be atliber1y to enter any premise or site on which the equipment may be and retake possession of the equipment. 2. HIRE PERIOD AND CHARGE PROCEDURE. The period of hire shall commence on the day the equipment order is delivered or collected and terminates on the day the equipment is collected by the Owners or returned to Owners possession. The method of charging the hirer is in accordance with the Owners price list and for any extended hire period the day of delivery will count as the first day of hire. 3. PAYMENT The payment for hire is due on demand at the time of delivery or collection. Unless agreed in writing any credit facility granted is made on the condition that payment in full without retention or set off is made within 30 days of the date of the invoice. The owners reserve the right to charge 2% above NatWest base rate accruing daily on any payment not made by the due date. 4. HIRER'S INDEMNITY The Owners take responsible precautions to ensure that all hire equipment supplied is of sound construction and workmanship. The Hirer must never the less by himself or his employees on receipt and from time to time during the hire inspect the equipment hired and satisfy himself that it is and continues to remain in a sound condition sufficient for any purpose for which it is being used and that it complies with all Statutory regulations. The Owners do not guarantee the soundness of sufficiency thereof and it will not be responsible for damage or loss that may occur through its unfitness or insufficiency or through wear and tear or decay and any express or implied condition statement or warranty not stated herein is hereby excluded. No liability is assumed for damage to magnetic media or CD or computer discs and no liability is assumed for loss damage or expenses resulting from interruptions in the operation of the equipment. The Hirer is to indemnify the Owner against all risks under this clause. 5. CUSTODY AND CARE OF EQUIPMENT. The Hirer shall be responsible for the safe custody of all equipment supplied on hire. In the event of equipment being lost, stolen, or destroyed in any way whatsoever whilst in the possession of the Hirer, the Hirer will compensate the Owners for the full cost of replacement from the maker or recognised supplier of that equipment and in the event of damage will compensate the Owners for the full cost of making good the damage. Any loss, theft or damage must be reported to the Hirer immediately and the hire charges for the lost, stolen or damaged equipment are payable and shall accrue and shall not terminate until payment is received in full for the aforesaid compensation and all other unpaid charges. The Owners reserve the right to exercise the above clause and also to determine any dispute under this clause at their discretion. It shall be the responsibility of the Hirer to see that the equipment is operated by a competent operator and will be responsible for the competent handling of the equipment and will not hold the Owners responsible for failure of the equipment through lack of knowledge of the equipment or lack of instruction or instruction manuals. |
